As acknowledged in the Proposal, the Kalshi Order is under the judicial review of the Honorable Jia M. Cobb of the U.S. District Court for the District of Columbia in the case of KalshiEx LLC v. Commodity Futures Trading Commission, 1:23-cv-03257 (filed Nov. 1, 2023) (D.D.C.). Because the substance and materials of those proceedings are directly relevant to this Proposal, I have attached them for the Commission to consider again in the context of this Proposal.
I urge the Commission to not blatantly ignore the constitutional doctrine of separation of powers and checks and balances that is the foundation of our government.
