In the interest of basic fairness, CFTC should NOT permit Kalshi to host its election markets unless it also permits PredictIt to resume operating normally.
Americans expect their federal government, which includes its regulatory agencies, to operate fairly and not handpick winners in an industry. Some of CFTC's actions in the past recent months have reasonably called into question on whether the agency is "promot[ing] responsible innovation and fair competition", such as eliminating one of Kalshi's current competitors, and without any due process (CFTC does not even explain how, in its view, PredictIt has violated the terms of its letter, nor does it give PredictIt an opportunity to defend and refute CFTC's claims). There are also reasonable concerns among the broader community as to whether CFTC is allowing itself to be improperly influenced by lobbying from Kalshi, especially by its current employees who formerly worked at the CFTC, to eliminate competition and competitors.
CFTC's role is to promote fair competition, as mandated by statue. If CFTC is actively eliminating other political betting venues (as it is), then it cannot and should not permit Kalshi to host its election markets.
