Banning election event contracts is a strict violation of the first amendment. The United States government has no mandate nor constitutional responsibility to ban event contracts based on the event that is related to the contract. To ban certain events from being seen as legitimate derivatives, you are restricting the people’s right to express themselves in a monetary manner. Additionally, banning electoral event contracts would strip the political science community of an essential benchmark used to predict outcomes. Betting markets are often more accurate than other forms of public data and many pundits will academically refer to them.
This rule is bad for the people, and should not be enacted by the CFTC.
