I am adopting Commissioner Mersinger's statement as my own comment on the proposed regulation. Any final rule from the CFTC that is inconsistent with this masterpiece of legal reasoning must address and explain in sufficient detail why you are taking a different view and why she is wrong. Her reasoning is sound and her points are cogent.
