I am submitting this comment because I believe the Commission needs to take strong regulatory action regarding event contract derivatives traded on prediction markets.
The current trajectory of prediction markets raises serious concerns about market integrity, insider trading, and the commodification of events that should not be allowed in the realm of financial speculation.
Event contracts that allow wagering on military operations, foreign policy decisions, terrorism, assassination, or other government actions involve unacceptable risks, since they mean that individuals with nonpublic information about those decisions have opportunities - and financial incentives - to exploit that information. Whenever there is a perception that government decisions could be influenced by private financial interests, it undermines public trust.
Therefore, the Commission needs to explicitly prohibit event contracts related to military operations, acts of war, terrorism, political assassinations, and non-financial government policy decisions, because they are contrary to the public interest.
In addition, where the outcome of any event contract can be known in advance or controlled by a specific individual or group, it must be assumed that, by definition, it is liable to manipulation, In other words, there should be a presumption against approval. These situations would include award show results, political speeches, corporate announcements, and any event where the insiders have advance knowledge.
Under the Commodity Exchange Act, the Commission has the authority and responsibility to prohibit event contracts that are contrary to the public interest. So the Commission must take action to prohibit these inappropriate and sometimes dangerous categories of event contracts, as well as strengthen the surveillance and enforcement mechanisms needed to detect insider trading: we must prioritize the integrity of markets and the public interest, not industry growth.
I respectfully ask the Commission to take action to ensure that the regulatory framework prioritizes public welfare over illegitimate areas for financial gain. There is a need for effective guardrails and rules to protect all aspects of our lives. There is a need to clearly signal that, in areas that are inappropriate for financial speculation, commodification is unacceptable.
